Family Law – Guardianship

When parents are unable to provide the care that their children need, whether as a result of substance abuse or other serious issues, often grandparents or family members will step forward to provide assistance. In such cases, these relatives may seek to establish legal guardianship.

Because legal guardians essentially have the rights and responsibilities of a parent, the issues and procedures in guardianship actions are complex. In addition, emotions often run high in these proceedings, particularly when family members have differing opinions as to the best way to care for the children.
